TEMPLE GARDEN RULES AND REGULATIONS

Any functions with the exception of bridal portraits are limited to only property owners.
Bridal portraits for non-property owners may be taken at the Temple Garden so long as a property owner sponsors the individual. The property owner must be present at the time the portraits are taken.                                                                                

If you wish to reserve the Temple Garden, please fill out the form attached below and return to the COA office, along with a deposit check made payable to Landfall COA in the amount of $250 which is due with this form at the time the reservation is made.  The check will only be cashed in the event the Temple Garden was not cleaned up after the function and to the standards of the Landfall Council of Associations, Inc.  All functions, to include weddings, are limited to 100 people or less.  Noise must be kept to a minimum to respect the privacy of the individuals who own homes that surround the Temple Garden area.
Cleanup of the Temple Garden area is the responsibility of the person making the reservation and must be done within 24 hours after the function.
Any chairs, tents, etc. are the responsibility of the person reserving the Temple Garden area. These items are not furnished by the Council of Associations.
In order to reserve the Temple Garden for use, a written request must be forwarded to the Landfall Council of Associations. The request should include the name of the person who is reserving the Temple Garden, the person they are sponsoring if applicable, the time and approximate length of the function, and if bridal portraits are taken, the name of the photographer. The mailing address for the Council is 1749 Drysdale Drive, Wilmington, NC 28405.
A written guest list must be forwarded to Security at the time of approval to ensure all guests are allowed entry. 
The COA Maintenance Department will be notified of any reservation to ensure the sprinkler system does not come on at that time of the function.

LOT RECOMBINATION POLICY
The Delegation of Powers and Authority delegates to the Council the following authority from each property association in Landfall:
"All authority with respect to architectural review and control, including but not limited to: approve lot resubdivisions and recombinations."
Therefore, the Landfall Council of Associations' directs the Architectural Review Board to not approve any lot recombination that has the effect of replatting two or more lots into one lot due to the impact the loss of a platted lot will have on the revenue collected by the Council, and in some cases assessments by individual associations that provide lawn maintenance or other services to their property owners.
This policy does not apply to lot recombinations on company-owned lots by Landfall Associates.
The Architectural Review Board will continue to review and approve other plat revisions, which may be submitted as referenced in the Delegation of Powers and Authority.

ACCOUNT MANAGEMENT POLICY

It is the policy of Landfall Council of Associations, Inc. to post funds received to any past due account before posting to current accounts. All accounts with a balance over 30 days beyond the due date will have a one-time late fee added. Effective January 2009, the late fee will be 10% of the semi-annual assessment in accordance with the NC General Statute 47F, The Planned Community Act. Interest may be added in accordance with the appropriate Association Declaration or Bylaws.

A lien will be placed on any property that is a full semiannual assessment behind in association assessments. A statement with late fee will be mailed 45 days after the due date of the unpaid assessment.   At that time, notice of suspension of privileges including deactivation of all barcodes related to the property will be given.  Prior to suspension of privileges, the owner will have an opportunity to be heard at a hearing of Landfall’s Adjudicatory Panel.  
A certified lien letter will be mailed if payment is not received within 30 days, and a $25 Administrative fee will be charged.  A lien will be placed on any property with an unpaid assessment 30 days after the date of the certified letter. If a lien is placed, a $200 charge will be added.  
Partial payments do not constitute a paid assessment. Each assessment that is unpaid is considered a late payment and is thus subject to the 10% of the semi-annual assessment late fee.  If Landfall entry barcodes are deactivated, an additional $25 administrative fee will be charged to reinstate barcodes when the account has been paid in full.

This policy has been approved by the Council of Associations and its Officers.

OPEN HOUSE GUIDELINES
Open houses can be held on Sundays from 1pm to 4pm, and must be by appointment only. The owner of the property that will be shown in the open house must give security a list of non-Landfall residents who will be attending prior to the start of the open house.
The people attending the open house from outside Landfall must be asked to use the gate closest to the open house (e.g. for Birkdale, the attendees should only use the Arboretum Gate). Security will check the attendees off the list as they come through the gates.
If someone comes to the gate and indicates that he/she is not on the list, Security will call the location of the open house to get approval from the homeowner for that person to enter Landfall. If Security is unable to reach the homeowner, the person at the gate will be sent to the Landfall Sales Office. Please note, while it may be understandable that a few people may not call to make a appointment, the homeowner should make every effort to ensure that the list of attendees is as complete as possible.
The above-described guidelines are meant to ensure that open houses are operated much like a private party held in Landfall. In that Security is made aware of the invited guests prior to the event. Those who approach the gate, but are not on the list will be required to receive property owner approval prior to entering Landfall. Again, if a person is not on the list it is likely that they will be denied access to Landfall, therefore the list should be as complete as possible.
